==Introducción==
Las [[Convenciones de Ginebra]] aplican en conflictos armados. La [[Tercera Convención de Ginebra]], Artículo 5, declara que el estátus de un detenido puede ser determinado por un "tribunal competente". Hasta tal momento, debe ser tratado como un [[prisionero de guerra]]. Después de que un "tribunal competente" ha determinado su estátus, el "Poder que lo Detiene" puede escoger acordarle al combatiente no priveligiado detenido los derecho y privilegios de un prisionero de guerra, tal como descrito en la Tercera Convención de Ginebra, pero esto no es requerido. La frase "combatiente no priveligiado" no aparece en la [[Tercera Convención de Ginebra]]<ref name=ICRC-210705/> Sin embargo, esta Convención describe categorías de casos en donde tal persona puede tener derecho a estátus de prisionero de guerra; y también existen otros tratados internacionales que rehusan el estátus de combatiente priveligiado para los [[mercenarios]] y [[niños soldados]].

=== Prisioneros de guerra ===
La [[Tercera Convención de Ginebra]], del 12 de agosto de 1949, define los requisitos para que un cautivo puede ser elegible para el tratamiento de prisionero de guerra. Un [[combatiente priveligiado]] es una persona quien comete actos beligerantes, y, cuando capturado, se trata como un prisionero de guerra. Un ''combatiente no priveligiado'' es alguien quien comete actos beligerantes pero quien no califica para el estátus de prisionero de guerra debajo de Articulos 4 y 5 de la Tercera Convención de Ginebra.
